The Terms of Use regulate the terms of receiving services and registering on the site.

The provisions of these Terms of Use describe the conditions under which the Webmaster can receive remuneration for advertising/transmitting an offer (offer to sell a Product) and carrying out business by the Advertiser on the principle of dropshipping.

Please read this document carefully to understand the rules for receiving services and receiving remuneration.

These Terms of Use are a public agreement between the user and the company regulating their relationship.

References to the words "you" or "your" (or similar words) mean our User, depending on the context of the Terms of Use.

References to the words "we", "our" or "us" (or similar words) mean 7Leads Company.

The words he/she and their derivatives in the text of the document may apply to both a male and female person, depending on the context of the document.

DEFINITIONS

Account is a functional part of the Site in the form of a User account containing his/her identification data, with which the User can access the Company's Services.

Webmaster is any individual or individual entrepreneur or legal entity that transfers the contacts of the Advertiser to the Company and receives a reward for each action of the Advertiser (Cost Per Action).

Advertiser is any individual or individual entrepreneur or legal entity that registers on the Site and receives Services from the Company for the purpose of selling their own Goods for by building a dropshipping scheme.

User is a common name for the Webmaster and the Advertiser.

Product is a product placed on the pages of the Site for sale / advertising / attracting new customers by the User.

User Consent (hereinafter referred to as "Consent") is a voluntary, specific, informed and unambiguous. expression of will, in which the User, by means of a statement or an obvious positive action, agrees to the terms of receiving the Services.

Personal data is any information in the public domain that allows directly or indirectly to identify the User. For example, first name, last name, telephone number, IP address.

Statistical data is any information that is publicly available and directly or indirectly relates to the user. For example, data on the name or address of the User's company.

The 7Leads Company (hereinafter referred to as the "Company" or "7Leads") is a service created to provide the Webmaster with the opportunity to receive funds for the Advertiser's actions, and the Advertiser to receive Services from the Company.

The 7Leads Company Website (hereinafter referred to as the "Site") means a web page or group of web pages on the Internet, located at: https://7leads.biz/, through which the Company provides Services to Users.

Third party - means an individual or legal entity, government agency, institution or body, different from the User or the Company.

Services - is an algorithm of actions performed by the Company and regulated by the rules of the Rules Use and consist in providing the Webmaster with the opportunity to receive funds for the actions of the Advertiser, and the Advertiser to develop his business.

USER CONSENT

The User enters into these Terms of Use by providing a complete and unconditional Agreement, without signing a written copy of the Terms of Use. If the User does not agree with the terms of the Terms of Use, the Company does not provide Services to such User.

Any of the following actions shall constitute Agreement with the terms of these Terms.

registration/authorization on the Site; and/or
User Consent; and/or
receipt of Services.

By entering into these User Rules, the User automatically confirms the fact of familiarization and agrees with the full and unconditional acceptance of their terms and conditions.

By agreeing to the terms of these Terms of Use, the Webmaster provides his/her direct Consent to:

registration on the Site to receive Services;
the amount of remuneration, which is indicated in the relevant section of the Site;
terms of receiving services;
terms of withdrawal of funds;
terms of payment for Services;
comply with the terms of the Terms of Use

REGISTRATION/AUTHORIZATION

To receive services, the User must register on the Site. To complete registration, the User must follow the link to the Company's telegram bot. And in the telegram bot, perform the following actions:

specify your e-mail;
select a traffic source;
select a field of activity;
specify the number of employees;
specify the financing of your activities;
indicate the number of leads for the last 30 days;
indicate the partners you worked with;
after completing the survey in the telegram bot, you need to confirm your registration by clicking on the link that came to the User's email.

After registration, the Company creates an Account for the User and a personal manager assigned to them in the Telegram messenger by providing a profile ID.

Using the Account, the User gains access to the Company's Services, including, but not limited to: selecting the User status and carrying out the corresponding activities (Webmaster and Advertiser); managing/changing/supplementing Personal and Statistical data; checking the balance and withdrawing funds; selecting a currency; receiving an offer (offer to advertise/sell the Product); communicating with Company representatives/personal manager.

Authorization on the Site is carried out by the User in the manner specified by the Company in the relevant section of the Site. To carry out authorization, the User undertakes to provide the Personal data specified by the Company.

The User undertakes not to disclose the data necessary to access his/her Account and bears sole responsibility in the event that a Third Party gains access to his/her Account. If the User has lost access to his/her Account, the Company may restore access to such Account if the User sends a request to the Company. Such a request must contain: the User's identification data, information about the Account, a document confirming the User's identity, a description of the problem that has arisen.

To delete an Account, the User must send a request to the Company. Such a request must contain the following information: the User's identification data, information about the Account, a document confirming the identity of the User, confirmation of the deletion of the Account. If a request is received, the Account and all information in it will be deleted permanently.

The User shall send a request to the Company at the following e-mail address: support@7leads.biz.

The Company shall consider the User's request within 15 (fifteen) business days from the moment of its receipt.

The User shall not transfer his/her Account to any Third Party in any way, since such transfer may entail a violation of intellectual and property rights. The User may grant access to his/her Account to a Third Party who will represent his/her interests and act on his/her behalf. In when the User grants access to his/her Account to a Third Party, the User shall be solely responsible for such person's compliance with these Rules Personal and Statistical Data and/or violations of intellectual rights.

PROVISION OF SERVICES

The Company provides the following services to the webmaster in the form of providing the opportunity to receive remuneration for advertising/promotion of the Advertiser's Products.

The Webmaster receives a reward for the following actions of the Advertiser:

Registration on the site;
Completed application;
Confirmed order;
Paid purchase.

The amount of the Webmaster's reward is specified by the Company in the relevant section of the Site. The amount and currency reward is specified by the Company in the relevant section of the Site. The Company informs that the amount of the Reward is specified in a fixed form, but in some cases the Company may specify the reward as a percentage of the order amount, the cost of the Product.

The Company provides the Advertiser with the following Services for the sale of the Product:

Collaborate with any CRM system;
Free technical setup of work;
5 levels of traffic quality analysis;
Detailed analytics on requests in your Advertiser Account;
A personal manager who will answer any questions.

The Company informs that the terms of provision of Services to the Advertiser are displayed in the Account of this Advertiser, including, but not limited to:

minimum cost of the Product;
purchase price (drop price) of the Product;
the size of the discount on the product in the form of a percentage;
the ability to create a flow and offer for the sale of the Product;
the size of the commission.

Using their own Account, the User, within the scope of receiving Services, can set up the GEO for the implementation of sales/advertisement of the Product and select the Product category.

PAYMENT FOR SERVICES

The Company receives payment for these Services in the form of a commission, as a percentage of the cost of the sold Products/received Webmaster remuneration, automatically calculated in favor of the Company using the payment system.

The amount of such commission is set in the corresponding section of the User's Account for each Product separately and can be changed by the Company unilaterally, and is displayed in the corresponding section of this Product.

The company operates in different GEO locations and that is why mutual settlements can be made in a currency other than hryvnia. Mutual settlements on the territory of Ukraine are made in hryvnia.

RETURN OF GOODS/FUNDS

The Company is not a party to the transaction for the sale of the Goods, and therefore does not carry out return/exchange of Goods of proper or improper quality in any case, including accepting claims for the quality, completeness of the Goods.

The Company does not return funds to the Webmaster paid in the form of a commission for the provision of Services, since the Webmaster is unilaterally responsible for the implementation of the advertising campaign of the Goods and attracting clients for the Advertiser.

INTELLECTUAL RIGHTS

All exclusive intellectual property rights to the program code, website design, as well as its components and their elements belong only to 7Leads.

7Leads grants the user a non-exclusive right to use the services and content of the Site.

The user grants 7Leads a non-exclusive right to use, copy, process and transfer Personal and Statistical data during the term of use of the Services.

The Advertiser guarantees that the Personal and Statistical data and information provided by it that relates to the Product does not violate the intellectual property rights of a Third Party.

The Advertiser guarantees that when using the trademark, it does not violate the property and intellectual rights of Third Parties and it has the right to dispose of the trademark on legal grounds.

A User who believes that his intellectual and property rights have been violated may contact the Company with a request at the following email address: support@7leads.biz. Such a request must include: the User's full name, a description of the problem, contact information, evidence of violation of intellectual and property rights. The Company will consider such a request within 10 (ten) business days from the date of receipt. By sending such a request, the User confirms that:

that the information provided therein is accurate and truthful,
understands the full extent of responsibility for sending inaccurate data,
guarantees that such information does not violate the copyright and/or other intellectual property rights of Third Parties;
confirms that it has all the rights and powers necessary and sufficient to send the request.

The Company may apply the following measures to a user who violates the intellectual rights of third parties:

block such User's access to the Account until the dispute regarding intellectual property with the Third Party is resolved;
delete the Account of such User.

The Company makes a decision on the application of penalties specified in the previous paragraph "g" solely on its own, with the possibility of applying several penalties or applying any sanction.

RIGHTS AND RESPONSIBILITIES

Webmaster's Responsibilities:

register on the Site;
respond to the Company's requests within 2 (two) business days from the date of receipt of such request;
advertise the Product and attract customers by legal means;
comply with the provisions of these Terms of Use.

The Webmaster's right:

receive a reward for advertising the Product;
withdraw funds from the balance specified in the Account to the payment details specified by the Webmaster;
gain access to the Account and carry out their activities using the Company's Services;
receive assistance from a personal manager;
receive services in full.

Advertiser's Responsibilities:

provide the Company with all information about the Product being sold;
register on the Site;
respond to the Company's requests within 2 (two) business days from the date of receipt of such request;
provide additional information about the Product, as requested by the Company;
comply with the provisions of these Terms of Use.

Advertiser's Rights:

sell the Product, but below the minimum cost of the Product;
advertise the Product;
withdraw funds from the balance specified in the Account to the payment details specified by the Webmaster;
gain access to the Account and carry out their activities using the Company's Services;
receive assistance from a personal manager;
receive services in full.

Company's Responsibilities:

provide the User with Services in accordance with the terms of these User Rules;
provide the User with access to the Account;
ensure that the User withdraws his funds from the balance displayed in the Account.

Company's Rights:

verify the identity, address and activities of the User;
apply sanctions to the User in accordance with the terms of these User Rules;
request any additional information from the User;
unilaterally make changes to these terms of use;
unilaterally change the terms of provision of Services, including their cost.

LIABILITY

7Leads does not represent the interests of either the Webmaster or the Advertiser and is not a party to the sale of the Goods; it only provides access to the Company's Services. That is why the Company does not bear any responsibility for any actions performed using the Site.

The Company shall not be liable for:

due to malfunctions in the operation of the Site caused by interruptions in the operation of equipment and software for failures arising in telecommunications or energy networks;
for any errors, omissions, interruptions, defects and delays in the processing or transmission of Personal and Statistical data, failures in communication lines, destruction of any equipment, unauthorized access of third parties to the Site, causing restriction of the User's access to Services;
to the User or any Third Parties for any direct and/or indirect damages, losses, including lost profits or lost data, damage to honor, dignity or business reputation, incurred in connection with his use of the Site and Services or the inability to use it;
for any damage to the electronic devices of the User or another person, any other equipment or software caused by or related to the User's use of the Site Services;
for the Webmaster's actions to attract customers for the sale of the Product;
for the Advertiser's actions to sell the Product;
for the compliance of the Services in whole or in part with the User's expectations, the error-free and uninterrupted operation of the Site, the termination of the User's access to the Services, as well as when saving the User's login and password that provide access to the Services, for reasons related to technical failures of hardware and software does not compensate the User for any losses associated with this;
for limiting/terminating the User's access to the Services, if such limitations and terminations arose as a result of force majeure circumstances that arose after the User accepted these Rules The use and occurrence of which the parties could not influence, including, but not limited to, such as: war, riots, strikes, sabotage, embargo, fires, floods, natural disasters, deterioration of the radio-electronic or radiological situation, explosions, actions and/or inaction of the government of Switzerland or another country, acts of state bodies and/or local governments, amendments to current legislation, accidents on public networks, changes in the conditions of access to linear-cable communication structures

The Company shall not bear any responsibility for the actions of the User performed by him for the implementation of sales using the company's services.

The Company and its affiliates are not liable for any losses, claims, liabilities or expenses arising from the User's receipt of the Services.

Since the payment for mutual settlements between the User and the Company, including the withdrawal of funds by the User from the balance, is carried out using a payment service that is not controlled by the Company, 7Leads bears no responsibility for the receipt of funds by the User upon receipt of the Services.

In the event of a violation by the User of the terms of the Terms of Use, the Company may apply the following sanctions to the User:

restrict the User's access to the Services (Account ban);
delete the Account and stop providing the Services.

The Company has the right to apply sanctions to the User specified in paragraph f of this section if the Company has any suspicion of:

the User violating these Terms of Use;
the User committing fraudulent actions;
the User providing false information and/or Personal Data;
the User violating the property and/or intellectual property rights of a Third Party.

7Leads reserves the right, but not the obligation, to:

monitor for violations of these Terms of Use;
take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such User to law enforcement authorities;
in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or otherwise burdensome to our systems;
administer the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

To the extent permitted by law, we provide the materials and Services on an "as is" basis. This means that we make no warranties of any kind, including, without limitation, warranties of fitness for a particular purpose.

7Leads, its affiliates and agents will not be liable for any delays or failures in Services caused by events beyond the control of the Company: acts of God, Internet failures, equipment failures, power outages, strikes, labor disputes, riots, insurrections, civil unrest, shortages, fires, floods, storms, explosions, acts of God, wars, hostilities, epidemics, pandemics, governmental actions, judicial orders, failures of Third Parties, or failures of transportation or business.

THE COMPANY IS NOT LIABLE FOR CONSEQUENCES CAUSED BY THE ACTIONS OF HACKERS, CRIMINAL MODIFICATION OF SOFTWARE, AS WELL AS OTHER TYPES OF NON-AUTHORIZATION, OR YOUR ACCOUNT.

LEGISLATION AND DISPUTE RESOLUTION

All relations between the Company and the User arising in connection with the fulfillment of the terms of these Services for the use of the Services, regulated by the legislation of Ukraine.

Any Dispute arising in connection with these Terms of Use, including any questions that relate to its existence, validity or termination, shall be referred to and finally resolved by a court of Ukraine, in accordance with the laws of Ukraine.

TERM

The Terms of Use are valid for the period of the user's use of the services. In the event of termination of the use of the Services and termination of relations between the parties, the terms of the Rules shall apply.

INTRODUCTION OF CHANGES

The Company has the right to make changes to the Terms of Use in the event of changes in the terms of provision of Services.

The User is obliged to familiarize themselves with the new terms of the Terms of Use and the Company shall not be liable if the User has not familiarized themselves with the new terms of the Terms of Use.

Our electronic or otherwise stored copies of the Terms of Use are considered to be true, complete, valid and legally binding versions of these Terms of Use your visit to the Site. If the user uses the services after the date of the rules update Users, we have the right to assume that the User has read the new version of the Rules Use and agreement with the terms of the Services.
